EXTREME REWARDS POLICIES AND PROCEDURES FOR MEMBERS OVERVIEW OF REWARDS PROGRAM - Extreme Rewards is a direct sales company engaged in the activity of selling its exclusive products to Customers & Members for personal consumption.
- Customer = A person or entity that makes a one-time purchase of products for
personal consumption. Customers are not entitiled to any benefits of the Rewards
Program. -
Reward Dollars earned by Members via the Rewards Program are intended to be used
for product discounts and free products.
- Members who make regular purchases, always earn Reward Dollars for their own
order as a reward for product pconusmption loyalty. Those applying to become Member must reach a certain criteria prior to joining. Applicants must reside in one of the 50 US States. Applicants must be the age of majority within the state, which he/she resides. Members must provide a vaild payment method for processing of their monthly order. Members must provide a valid shipping address. Applicants
must complete an official Extreme Rewards Application either by: Once the application is complete, it must be sent or transmitted to Extreme Reward's home office and accepted, with notice of acceptance received by the applicant. This may all be done on-line and through e-mail, verbally, or by regular mail. Members may enroll on the Basic (1 vehicle) or Premium Membership (multiple vehicles)program. Extreme
Rewards is not a business or income opportunity, and thus a Social Security Number
or Tax ID# for a Membership is not required at the time of application to become
a Rewards Member. In the even the Member requests cash redemption at anytime in
the future, they will then be required to provide this information. 2 PARTNERSHIP OR CORPORATION REQUIREMENTS Entering Extreme Rewards as a corporation or partnership is as simple as that of an individual. A Membership may be acquired upon completion of the proper form(s). With the use of the appropriate documentation, a Member may change its status under the same sponsor from individual to partnership or corporation; or from partnership to corporation. 3 REFERRING OTHER CUSTOMERS MEMBERS
Members, once admitted as a member, have the option to refer other potential Customersand
Members anywhere within the United States. This may also occur in other foreign
countries as they may be opened by Extreme Rewards, bearing in mind the need for
personal contact. Every person, partnership or corporation has the absolute right to choose his/her/its own referring Member when they initially sign-up as a Member with Extreme Rewards. Therefore, if there are two Members that claim to be the referring member of the same new Member, Extreme Rewards shall acknowledge the first application received at corporate headquarters. Any cross-referring is strictly prohibited within the Extreme Rewards organization. Example: Contacting a member that you did not refer in an attempt to refer them into your line in Extreme Rewards or any other program or company that may sell competing products with Extreme Rewards. International Referring - Pursuant to Extreme Reward's International Program, members may refer people in all countries in which Extreme Rewards is authorized to conduct sales of its products. Members may not import, export, or distribute Extreme Rewards products in any manner outside the USA. 4 TRANSFERS OF REFERRAL CREDIT Extreme Rewards prohibits any transferring from one member to another. A Member will only be allowed to transfer to a different referring members by way of written resignation to the company. Once resignation is accepted, the former Member may then choose to rejoin as a member after six (6) under a new referring member. IMPORTANT: Memberz who choose to resign and return will not be allowed to transfer their referral organization with them. 5
DEATH OF MEMBER In order to protect the company from fraud, Extreme Rewards requires a certificate of death and a certified copy of the will, trust or other device before the company may effect transfer of the deceased Member's membership to the named transferee. The successor Member shall be required to execute a new Extreme Rewards application. 6 TRANSFER/ASSIGN OF MEMBERSHIP Members are at liberty to assign or transfer their memberships at any time. However, the assignment is subject to the approval of Extreme Rewards prior to the assignment. The approval is necessary in order to protect the integrity of the company and to insure that fraud is not being committed. Extreme Rewards reserves all rights to accept or reject any assignment or transfer based on qualifications of new member, misrepresentation by transferring member, or any further issues that may arise resulting in potential detriment to Extreme Rewards. 7 REPRESENTATIONS, SELLING, AND SHIPPING BY MEMBERS Members are NOT independent contractors, distributors, employees, or representatives of Extreme Rewards. They are Members of a Rewards Program similar to Flyer Miles Programs. The agreement between Extreme Rewards and its Members does not create an employer/employee relationship, agency, partnership or joint venture between Extreme Rewards and the Members. Members are NOT authorized to make product sales after they receive their Members Orders. Membership in the Extreme Rewards Program is based solely on personal product consumption on a monthly basis. Members must not represent themselves in any way, orally or in writing, as being an agent or employee of the company. Members have no authority to bind Extreme Rewards to any obligations. Each Member shall hold Extreme Rewards harmless for any claims, damages or liabilities arising out of the Members own activities. Extreme Rewards will take aggressive action to insure that Members that violate this policy are terminated. Extreme Rewards may at times provide products to our Members that are usable for personal consumption or for sharing with friends and family. These are not intended for profitable transactions. Members can choose to consume or share these products that come in special packaging. Members are responsible for any expenses, which result from their efforts to refer other Members and/or Customers. Members may not use the company name on any written forms or documents (e.g. stationery, bank accounts, business signs) without stating "Independent Member" and must obtain prior approval by the company. Members are NOT allowed to re-ship EnviroMax Plus. This includes via US Postal Service, UPS, FedEx, or any other courier service etc. EnviroMax Plus is a regulated material and can only be shipped by Extreme Rewards through UPS. The only time Members are allowed to ship EnviroMax Plus is when returning an unopened and unused original box sent back to the warehouse via UPS. If a member would like to send a shipment of EnviroMax Plus to a friend or prospect, that member can place an order on their Member Office, and enter the friend's address as the 'Ship to Address'. 8 REWARDS GENERATED and REWARDS CAPS Consumable products and the sales of products to the member and/or customer, are the foundation of Extreme Rewards. All the Rewards Dollars generated are solely and entirely based on Extreme Rewards selling products directly to end users for personal consumption. 9 REFERRAL OF CUSTOMERS Additional Rewards and bonuses are generated for our members who develop a referral-based organization of additional Members and Customers. Extreme Rewards offers free web sites, & mini product samples to assist those members who want to refer. 10 UNETHICAL BEHAVIOR OR ACTIVITY Extreme Rewards will not permit activity that is obviously unethical or unprofessional. Even though the line between aggressive referring efforts and unethical behavior and harassment can be vague, Extreme Rewards will intercede when such behavior is evident, and reserves the right to use its sole judgment in deciding whether certain Member activities are inappropriate and, if determined to be so, to act accordingly. 11 REFUND POLICY Extreme Rewards will refund any dissatisfied purchaser of any Extreme Rewards products as follows: 90-day Return/Refund Policy - Extreme Research will refund 50% of the purchase price of any unopened COMPLETE packages of product that is returned within 90 days of the date of purchase of the product, and that are returned in the original packaging. (50% refund does not include shipping and handling charges from the original order). Member/Customer is responsible for the shipping fees to return product. All products must be shipped in original box via United Parcel Service. Contact Customer Service at (321) 723-4003, M-F 9-6 PM EST for a return authorization #. Where
to Send Returns > *Email or Call first to obtain an RMA number 12 SALES TAX All Extreme Rewards products may be subject to the sales tax in the state, county, or city that levies such a tax and in which a sale occurs. This tax should be calculated on the sale price of the purchase. 13 INDIVIDUAL TAXES FROM REWARDS REDEMPTION Each Member that requests Cash Redemption of their Rewards, shall comply with all state and local taxes and regulations governing the Income Tax liabilities of Extreme Rewards Cash Redemption. Extreme Rewards does not deduct any taxes from Rewards Redemption Checks. At the end of the calendar year, Extreme Rewards is obligated by law to provide the Member and the Internal Revenue Service with a form 1099 reporting the member's annual income from Extreme Rewards. This is required for any Members with Cash Redemption in excess of $600.00 for the calendar year. 14 PROPRIETY NATURE OF DOWNLINE REPORTS The company may from time to time supply data processing information and reports to Extreme Rewards Members concerning their referral organizations. The Member agrees that such information is proprietary and confidential to both the company and the individual Member and is transmitted to the Member in confidence. The Member agrees that he/she will not disclose such information to any third party directly or indirectly, nor use the information to compete with the company directly or indirectly. The Member and the company agree that, but for this agreement of confidentiality and nondisclosure, the company would not provide the above confidential information to the Member. Members may not contact any members of their Extreme Rewards referral organization, other than their personally sponsored members, in an attempt to promote other products or services unless it is authorized by Extreme Rewards. Members may not contact any members of the Extreme Rewards organization, other than their personally sponsored members. This is considered cross-sponsorship or cross-recruiting and is strictly prohibited within the Extreme Rewards organization. Members may contact the customers and members in their referral organization only to assist them with product consumption and in referring other customers and members. 15 AMENDMENTS Extreme Rewards expressly reserves the right to alter or amend product prices, product availability and/or formulation, policies and procedures, and the Rewards Plan. Such amendments are automatically incorporated as part of the agreement between Extreme Rewards and the Member when published in official company literature, notices, and/or web sites & member online office. 16 PRODUCT AND REWARDS EARNING CLAIMS Extreme Rewards Members agree to make no false or fraudulent representations about the company, its products, services, the Rewards Plan, or Rewards earnings potential. This includes the showing of redemption checks, statement of earnings, or potential earnings. One persons Rewards earnings may not be typical of another's earnings and therefore, no Reward Redemption claims are allowable. The Member must not make any claims for Extreme Rewards products, which are not supported by facts contained in official company literature. 17 MEMBER CHANGE OF ADDRESS Members must report any change of address by updating their account record in their online member office, or by contacting via telephone, or sending written notice to Extreme Rewards office. 18 RESIGNATION OF A MEMBER Members have the right to cancel their Member account and this agreement at any time and for any reason, or without reason, without penalty by giving written notice to the company at its principal place of business. Upon receipt of the notice, all rights to Rewards, position, and the benefits of the Rewards Membership cease.
Resigning Members will be placed in a inactive status. During this inactivity
period, members are not able to accumulate or earn any additional rewards. 19 CANCELATION BY INACTIVITY After two (2) months of consecutive inactivity, including 2 months of failed autoship processing, an inactive Member will be placed in a inactive status and their Membership will be suspended. During
this inactivity period, members are not able to accumulate or earn any additional
rewards. 20 TERMINATION OF MEMBERSHIP The company reserves the right to terminate any membership at any time, or suspend said Member for a probationary period, when it is determined that the Member has violated the provisions of the Member Agreement, including the provisions of these Policies and Procedures as they now exist or may be amended, or the provisions of applicable laws and standards of fair dealing. Upon such a termination, the company shall notify the Member by email, fax, or mail at the latest address listed with the company. The terminated Member agrees to immediately cease representing himself/herself as a Member, and will not be allowed to ever return to the position of Member with Extreme Rewards. Where applicable state law on termination of a Member is inconsistent with company policy, such state law termination procedures shall be in force. If the Member wishes to appeal the termination, Extreme Rewards must receive the appeal, in writing, within twenty (20) days from the date of mailing of the company's termination letter. If the appeal is not received with the 20-day period, the termination will be automatically deemed final. If the Member files a timely appeal of termination, Extreme Rewards will review and reconsider the termination, consider any other appropriate action and notify the Member of its decision. The member agrees that the decision of the company will be final and subject to no further review. In the event that the termination is not rescinded, the termination will be effective as of the date of the company's original termination notice. Upon termination of a membership, all rights to commissions, position, and purchase rights cease. The Member will not be eligible for future sponsorship. 21 MEMBER MARKETING, ADVERTISING & EMAIL Because Members can generate Rewards by referring other Customers and Members they may share the products and the Rewards Program in any legal and ethical manner, and may advertise without company approval, provided that they do not use the corporate name, logo or trademarks. Any advertisement, not supplied by Extreme Rewards, which utilizes the company name, logo or trademarks, must be approved by the company prior to any advertisement. The ad must also state that the individual placing the ad is an "Independent Member". All material that is displayed on the company or replicated websites is acceptable for marketing purposes with the exception of any material referring to Johnny Rutherford MAY NOT BE USED. Any such reference requires company approval. Any marketing material that deviates in any manner or uses wording dissimilar to that on the website must be submitted to Extreme Rewards for approval prior to use. Members are given access to approved promotional material in their Online Member Office. This material has already been approved by Extreme Rewards and the Member does not need prior approval before using this material. Independent Members are prohibited from answering the phone in any manner that would give callers reason to believe that they have reached the corporate offices of Extreme Rewards. Members are provided a host of web sites and personalized web sites that are provided by Extreme Rewards to Members for FREE. Members may develop their own separate website only after approval from Extreme Rewards. Request for approval must be submitted to Extreme Rewards in writing. Once a web site is approved, no changes may be made to the content of the web site without prior approval of Extreme Rewards Unless prior approval is received, the only websites allowed are the websites provided by the Company, as part of the membership package. These sites may not be altered. Members may not use bulk email or email lists to drive visitors to their personalized Extreme Rewards web site. In addition, Members may not send email to drive visitors to a separate website, then automatically redirect those visitors to their personalized Extreme Rewards web site. Members can send email to direct visitors to a separate web site, and then use a link on their separate web site to their personalized Extreme Rewards web site. Members can use appropriate and legal Internet advertising such as banners, search engines, etc, to drive traffic to personalized Extreme Rewards web site or a site that redirects visitors to their personalized Extreme Rewards website Marketing & Advertising Policy There are many ways to advertise such as: business cards, flyers, newspaper ads, direct mail, email, fax, radio & televisions, billboards, Internet, and more. Independent Marketing Campaigns: If you do decide to create you own Marketing and Advertising, you are required to follow the guidelines listed below. If you follow these guidelines, you do not need approval from Extreme Rewards to create your Marketing and Advertising: A) All marketing and advertisements from Members delivered in person, by email, by fax, by postal mail, on radio or TV, or on Billboards, must reflect that you are an "Independent Member of Extreme Rewards". This includes but is not limited to business cards, flyers, newspaper ads, radio & television, billboards, direct mail. B) When creating your marketing and advertisements, you must use the EnviroMax Plus claims that are on your web site and/or any the official corporate documents. You ARE NOT allowed to make any changes to these claims in your marketing and advertisements. For example, here are the approved benefits and claims of EnviroMax Plus as posted on your web site: 1.

The most common web site marketing Members do is to register a catchy name, like savenowongas.com, and then they have that site redirected to your personal Extreme Rewards web site. You cannot alter you Member web site that is owned by Extreme Rewards. E) Regarding orders outside our system. Extreme Rewards will not accept orders from any outside shopping carts or ordering processes. We will accept orders by fax or by phone on the order line. Thus if you want to create orders then fax them to us, we will process these with a $2.00 processing charge.
Extreme Rewards will supply products that are purchased online, via phone, or via faxed order. All orders must be prepaid with a personal check via bank draft, or an approved credit card. Orders may also be mailed to Extreme Rewards Customer Service office with a with cashier's check, or Money Order 24 WAIVER The company maintains its right to insist on compliance with these rules or with the applicable laws governing the conduct of a business. This is true in all cases, both specifically expressed and implied, unless an officer of the company who is authorized to bind the company in contracts or agreements specifies in writing that the company waives any of these provisions. 25 GOVERNING LAWS These rules are reasonably related to the laws of the State of Florida and shall be governed in all respects thereby. The parties agree that jurisdiction and venue shall lie with the place of acceptance of the Member application, which shall in all cases be in the State of Florida. 26 INVALIDITY OF ANY PARAGRAPH Should any portion of these policies and procedures, of the Members Application and Agreement, or any other instruments referred to herein or issued by the company be declared invalid by a court of competent jurisdiction, the balance of such rules, applications, or instruments shall remain in full force and effect. 27 SANCTIONS AND ENFORCEMENT ACTION
Sanctions will not be employed lightly, nor will the company be arbitrary or unfair
in their use. It is important to remember, however, that a Member who violates
these policies and procedures jeopardizes the integrity and standing of all Members. 28 NOTICES TO Extreme Rewards Any notice to Extreme Rewards should be sent to the Customer Service office at: Extreme
